What is a Leave & License agreement?

The basics

A Leave & License agreement is a legal contract between a property owner (Licensor) and a person or business who wants to occupy the property temporarily (Licensee) — usually for 11 months or less. It's common for residential flats, retail shops, offices, and commercial spaces in Maharashtra.

The agreement spells out:

  • Who can live or operate in the space (the Licensee)
  • How long they can stay (the license period)
  • What they pay monthly and when (the license fee)
  • What they can and cannot do with the space
  • When and how the agreement can be cancelled
  • Who is responsible for maintenance, utilities, and repairs

Why register under the Maharashtra Rent Control Act?

How registration works

Registration is straightforward and fast when done correctly:

Both parties sign the agreement

The Licensor and Licensee sign the Leave & License agreement with two independent witnesses.

Visit the Sub-Registrar

Go to the Sub-Registrar's office in the jurisdiction where the property is located.

Pay registration fees

Get the registered copy

The Sub-Registrar stamps and registers the agreement. Both parties get certified copies.
